User Declaration, Consent and Undertaking

1. User Identification and Applicability

For the purpose of this Declaration, "User" means any Candidate, Trainee, Job Seeker, Employer, Recruiter, Corporate Client, Training Partner, Assessment Partner, Certification Partner, Franchise Partner, Vendor, Service Provider, Consultant, Organisation, or any other individual or entity accessing, registering with, interacting with, or availing services from Jump2Join Private Limited ("Jump2Join").

This Declaration shall apply to the User to the extent relevant to the nature of their relationship and interactions with Jump2Join.

2. Declaration of Accuracy

I/We declare that all information, documents, certificates, licences, registrations, qualifications, identity proofs, employment details, business details, and other information submitted to Jump2Join are true, correct, complete, genuine, and not misleading.

I/We understand that submission of false information, forged documents, impersonation, concealment of material facts, or misrepresentation may result in:

• Suspension of services.
• Termination of registration.
• Cancellation of services.
• Blacklisting from future services.
• Recovery of losses or damages.
• Legal action wherever applicable.

3. Consent for Data Processing

I/We voluntarily consent to the collection, storage, verification, processing, retention, transfer, and lawful use of personal, professional, organisational, and operational information by Jump2Join for:

• Registration and profile management.
• Training, assessment, certification, and educational activities.
• Recruitment, placement, and workforce-related services.
• Employer onboarding and service delivery.
• Government scheme implementation and compliance.
• Audits, investigations, legal obligations, and regulatory compliance.
• Communication, support, and operational purposes.

I/We acknowledge that such processing may be carried out in accordance with the applicable Privacy Policy, applicable laws, and any consent provided by me/us from time to time.

4. Consent for Information Sharing

I/We authorise Jump2Join to share relevant information with employers, candidates, recruiters, training partners, assessment agencies, certification bodies, government authorities, auditors, technology service providers, and other authorised stakeholders to the extent reasonably necessary for service delivery, compliance, and related purposes.

5. Third-Party Information Disclaimer

I/We acknowledge that Jump2Join may rely upon information, documents, declarations, requirements, representations, and data provided by Candidates, Employers, Recruiters, Training Partners, Assessment Agencies, Government Authorities, Educational Institutions, Service Providers, and other third parties.

While Jump2Join may undertake reasonable verification processes where appropriate, Jump2Join does not warrant or guarantee the completeness, accuracy, authenticity, legality, reliability, suitability, or continued availability of information supplied by such third parties.

The User remains solely responsible for the accuracy, legality, completeness, and authenticity of information provided by the User to Jump2Join.

6. Training, Service and Platform Compliance

I/We agree to comply with all applicable laws, platform rules, programme guidelines, service requirements, assessment procedures, attendance requirements, safety instructions, and operational policies applicable to the services being availed.

7. Placement and Employment Acknowledgement

Where applicable, I/We acknowledge that:

• Jump2Join acts as a training provider, recruitment facilitator, placement facilitator, workforce development organisation, and service platform.
• Registration, training completion, certification, assessment participation, or use of the Platform does not guarantee employment, hiring, business opportunities, placements, projects, contracts, revenue, or commercial success.
• Hiring, engagement, compensation, deployment, retention, and related decisions remain solely with the relevant employer, organisation, client, or service recipient.

8. Candidate Joining Commitment

Where the User acts as a Candidate, Trainee, or Job Seeker, the User agrees to make reasonable efforts to honour accepted interview schedules, offer acceptances, onboarding formalities, joining commitments, and employment-related obligations.

Repeated failure to honour such commitments may result in restriction, suspension, or discontinuation of placement assistance and related services.

9. Professional Conduct, Anti-Fraud and Anti-Bribery Undertaking

I/We undertake not to engage in any unlawful, unethical, fraudulent, or misleading activities, including but not limited to:

• Fraud.
• Theft.
• Misappropriation.
• Forgery.
• Cheating.
• Corruption or bribery.
• Harassment or abusive conduct.
• Misuse of confidential information.
• Submission of fake or forged documents.
• Any unlawful, unethical, or misleading activity.

I/We further undertake not to demand, offer, promise, pay, receive, or facilitate any unlawful payment, commission, gift, favour, or benefit in connection with any service, placement, employment opportunity, assessment, certification, or business transaction.

10. Professional Conduct Undertaking

I/We undertake to maintain professional, ethical, lawful, and respectful conduct while interacting with Jump2Join, its employees, representatives, candidates, employers, partners, vendors, customers, and other Users.

Any abusive behaviour, harassment, intimidation, threats, defamatory statements, reputational attacks, unlawful conduct, or misuse of the Platform may result in suspension, termination, restriction of services, legal action, or any other action permitted under applicable laws and company policies.

11. Photo, Video and Communication Consent

I/We voluntarily consent to:

• Receiving communications through telephone calls, SMS, WhatsApp, email, mobile applications, notifications, and other lawful communication channels.
• The use of photographs, videos, testimonials, participation records, training records, success stories, and related content for documentation, compliance, reporting, promotional, educational, and marketing purposes, subject to applicable laws.

12. Policy Acceptance

I/We acknowledge that I/We have carefully read, understood, and agreed to comply with the applicable:

• Terms & Conditions.
• Privacy Policy.
• Placement Disclaimer & Employment Terms.
• Refund & Cancellation Policy.
• Grievance Redressal Policy.
• Other applicable policies, agreements, declarations, and guidelines published by Jump2Join from time to time.

I/We understand that the provisions relating to disclaimers, limitations of liability, risk allocation, indemnification, dispute resolution, payment obligations, commercial obligations, and other legal provisions contained therein shall apply to my/our use of the Services.

13. No Oral Representations

I/We acknowledge that no employee, trainer, counsellor, recruiter, franchisee, consultant, representative, partner, vendor, or third party is authorised to make any guarantee, assurance, commitment, promise, representation, or warranty on behalf of Jump2Join unless expressly approved in writing by an authorised representative of Jump2Join.

I/We agree not to rely upon any verbal assurance, informal communication, WhatsApp message, social media communication, advertisement interpretation, or statement not officially issued or approved by Jump2Join.

14. Indemnity Undertaking

I/We agree to indemnify, defend, and hold harmless Jump2Join, its directors, officers, employees, representatives, affiliates, partners, and service providers against any losses, liabilities, claims, penalties, damages, investigations, legal proceedings, advocate fees, settlements, and expenses arising from:

• False declarations.
• Submission of fake or forged documents.
• Violation of applicable laws.
• Misconduct.
• Fraudulent activities.
• Breach of policies, agreements, declarations, or obligations.
• Violation of third-party rights.

This obligation shall survive suspension, termination, cancellation, expiry, or discontinuation of services.

15. Survival

The declarations, consents, acknowledgements, undertakings, indemnity obligations, confidentiality obligations, and other provisions intended by their nature to survive shall continue to remain valid and enforceable notwithstanding suspension, cancellation, termination, expiry, withdrawal, or discontinuation of services or association with Jump2Join.

16. Electronic Consent and Acceptance

I/We acknowledge that acceptance through physical signature, digital signature, electronic signature, OTP verification, website registration, mobile application registration, checkbox acceptance, electronic communication, or continued use of the Services shall constitute valid and legally binding acceptance of this Declaration to the fullest extent permitted under applicable law.

17. Governing Law and Jurisdiction Acknowledgement

I/We acknowledge that all applicable policies, agreements, declarations, and services provided by Jump2Join Private Limited shall be governed by and interpreted in accordance with the laws of India.

I/We further acknowledge and agree that any dispute, claim, or legal proceeding arising out of or relating to the use of Jump2Join Services shall be subject to the dispute resolution mechanism and jurisdiction provisions contained in the applicable agreements, declarations, policies, and Terms & Conditions accepted by me/us.

18. Cost Recovery and Enforcement

Where permitted under applicable law, the User agrees that Jump2Join may recover reasonable losses, damages, costs, expenses, and other amounts incurred as a result of the User's breach of this Declaration, applicable policies, agreements, contractual obligations, or legal requirements.

Such recoverable costs may include, but are not limited to:

• Legal costs and advocate fees.
• Investigation expenses.
• Recovery and enforcement costs.
• Administrative and operational expenses.
• Compensation for losses or damages suffered by Jump2Join.
• Any other recoverable amount permitted under applicable law.

19. Final Acknowledgement

I/We hereby declare and confirm that:

• I/We have carefully read and fully understood this User Declaration, Consent and Undertaking.
• I/We voluntarily agree to all terms, conditions, declarations, consents, undertakings, and all applicable policies, agreements, guidelines, and documents published by Jump2Join from time to time.
• I/We confirm that all information, declarations, documents, and details provided by me/us are true, complete, accurate, and valid as on the date of acceptance of this Declaration.
• I/We understand the rights, responsibilities, obligations, risks, legal consequences, and liabilities arising from this Declaration and agree to comply with the same.
